Currently, there are several states where medical marijuana is legal, but it is still illegal at the federal level. What should an HR professional do if a physician or health care worker tests positive during pre-employment testing or comes forward with a prescription for medical marijuana? There are ramifications for the employer from an ADA and FMLA perspective, but also issues regarding patient safety to consider.
