  1. New Health Insurance Marketplace Coverage Options and Your Health Coverage

    There is a requirement under health care reform (the Patient Protection and Affordable Care Act – PPACA) that employers provide a written notice to their employees about health coverage options available through the new insurance exchange (or, as it is now called, the marketplace). Recently, the US Department of Labor (DOL) provided temporary guidance and model notices to help employers comply with this requirement. The basics of this guidance are summarized below. The DOL model notice that may be used by an employer that offers health coverage to some or all of its employees can be downloaded here. Please note that there are some employer specific provisions that must be included in the notice.

    Highlights of the Guidance:

    • Recipients: Notice must be provided to all employees, regardless of employment classification (such as part-time, full-time, temporary employee). It does not need to be provided to others who may be participants in the employer’s health plan but who are not employees (such as dependents).
    • Content: The model notice may be used to ensure compliance with the content requirement, but in general, the notice must (i) inform the employees of the existence of the marketplace, (ii) describe the services provided by the marketplace, (iii) describe the manner in which employees may contact the marketplace to request assistance, (iv) inform employees that they may be eligible for a premium tax credit if the employee purchases a qualified health plan through the marketplace, and (v) inform employees that they may lose the employer contribution (if any) for any health plan offered by the employer and that all or a portion of that contribution may be excludable from income for federal income tax purposes.
    • Timing: The notice must be provided to all current employees before October 1, 2013. For employees hired on or after October 1, 2013, the notice must be provided to them within 14 days of their start date.
    • Form: The notice must be written in a manner calculated to be understood by the average employee and provided automatically, free of charge.
    • Method of Delivery: The notice must be provided by first class mail or electronically (provided the requirements for the DOL’s electronic disclosure requirement are met).
